THE ZULU NYALA GROUP TERMS OF TRADE 


Between the Guest

and

The Zulu Nyala Group (Registration No. 1981/004980/07) (“The Zulu Nyala Group”/ “We”/ “Us”/ “Our”)

The Zulu Nyala Group, comprising Zulu Nyala Game Lodge (Pty) Ltd & Little Fetterangus T/A Zulu Nyala Heritage Safari Lodge & Tented Camp (Pty) Ltd, hereby referred to collectively, operates as a single entity within South Africa.


By signing this agreement, the Parties mutually agree to abide by the terms outlined herein. In the event that these Trading Terms are not formally signed by the Client, the act of placing any Booking, whether via electronic mail or any other means, shall be deemed as acceptance of the terms of this agreement by the Client.


CONDITIONS: THE ZULU NYALA GROUP TERMS OF TRADE

(Note: While The Zulu Nyala Group endeavours to standardise these Trading Terms, variations may be necessary for third-party supplier Bookings. In such cases, the Guest will be duly notified at the time of Booking).


1.1. GENERAL

1.1.2. Itineraries for Photo Safari Packages may be subject to change at any time, due to unforeseen circumstances beyond the control of The Zulu Nyala Group. Efforts will be made to adhere to planned itineraries.

1.1.3. The Zulu Nyala Group reserves the right to modify or withdraw Photo Safari Packages or any part thereof as deemed necessary. Any resulting expenditures or losses due to events beyond our control may be passed on. In the event of pricing variations due to such circumstances, adjustments to Photo Safari Packages costs or itineraries may be made as required.

1.1.4. The Zulu Nyala Group retains the right, at its discretion, to cancel a Booking if deemed necessary in the interest of The Zulu Nyala Group, with a full refund of all monies paid for such Booking.

1.1.5. The safekeeping of baggage and personal effects remains at the Guest’s risk. The Zulu Nyala Group assumes no liability for lost or damaged baggage.

1.1.6. The Guest must procure travel insurance covering medical expenses. Any and all cost related to medical evacuation cover and independent medical support for critical incidents will be recovered from the Guest's travel insurance provider.

1.1.7. By virtue of the fact that The Zulu Nyala Group utilises third-party air travel services, it disclaims responsibility for flight delays, cancellations, or schedule inaccuracies. Flights must be paid in full and are subject to cancellation and refund terms determined by the carrier.

1.1.8. The Zulu Nyala Group may capture photographs during Photo Safari tours for promotional purposes. Guests booking a Photo Safari package consent to the use of such photographic images. Guests wishing to opt out should notify The Zulu Nyala Group before final payment.


1.2. PHOTO SAFARI PACKAGE TERMS & CONDITIONS

1.2.1. The Photo Safari package may not be re-donated back to any organisation.

1.2.2. Rates and information are subject to change. Please contact Zulu Nyala’s reservation team to receive current information.

1.2.3. The Photo Safari package is valid for 2 years from Date of Purchase and is Non-Refundable.

1.2.4. The Photo Safari package can only be transferred to another person with written permission from the Photo Safari office.

1.2.5. There is an admin fee of $110 for the name change if transferred.

1.2.6. The expiry date can be extended for another 6 months at an additional fee of $275 per couple or another year at an additional fee of $550 per couple. Kindly note that the auction package extension allowance is a maximum of 2 years from the date of expiry. Thereafter, the package will be forfeited.

1.2.7. The Photo Safari package may not be passed to other organisations and may not be

bartered or sold in any other manner, unless permission is given by the Photo Safari office.

1.2.8. The Photo Safari package excludes accommodation at the Game Lodge;

However a surcharge is applied should guests wish to upgrade their package.

1.2.9.Regarding our signup & post-auction protocols, agents/organisations agree to adhere to the following:

1.2.9.A. Step one: Every time there is a new fundraiser, agents/organisations must sign up via the Fundraising Auction Package Signup Form and let us know the exact fundraising date.

1.2.9.B. Step two: Once the fundraiser is over. The organisation must fill out the Winning Bidders Information Form in full detail.

1.1.9.C. Step three: The organisation must transfer 50% of the sale price to Zulu Nyala within 30 days of the auction. 


1.3. PHOTO SAFARI PACKAGE INCLUSIONS:

1.3.1. Six nights’ accommodation for 2 people at Zulu Nyala Heritage Safari Lodge or Hemingway Tented Camp (depending on availability - Standard Room or Tent). 

1.3.2. The following meals are included: Day 1 – Lunch & Dinner; Day 2 through Day 6 – Breakfast, Lunch, Dinner; Day 7 – Breakfast.

1.3.3. Two game viewing per person per day on Zulu Nyala Game Reserve (morning and afternoon drive). Please note, that whilst we love children at Zulu Nyala, for safety reasons there is an age restriction placed on game viewing activities. No child younger than 5 years of age will be allowed to go on a game drive.


1.4. FACILITIES & SERVICES

1.4.1. Whilst care is taken to ensure that the description of facilities and services at Zulu Nyala is accurate, these are continually being changed, upgraded and on occasion taken out of service. It is the guests responsibility to confirm with Zulu Nyala prior to making your booking that the feature/facility will be available during their stay.

1.4.2. Zulu Nyala is not liable for omissions, errors or changes to the facilities and services at the properties, whether temporary or permanent.

1.4.3. Accommodation facilities listed online or on any promotional documentation may not apply to all room types. 

1.4.4. Please also note that whilst Zulu Nyala attempts to satisfy all special requests, we do not guarantee that special requests can be accommodated.

1.4.5. NO FOOD AND BEVERAGE OR ALCOHOL TO BE BROUGHT ON SITE. 


1.5. PRICING

1.5.1. Photo Safari package prices include The Zulu Nyala Group’s fees for itinerary planning, handling, and operational charges, quoted based on prevailing exchange rates, tariffs, and applicable VAT.

1.5.2. Scheduled Activities encompass entrance fees where specified. The Zulu Nyala Group reserves the right to adjust excursion prices due to factors such as currency fluctuations, tariff changes, and applicable taxes.

1.5.3. All rates are quoted in South African Rand and include Value Added Tax (VAT) at the prevailing rate. 15% for South African Properties (should VAT change, the appropriate rate adjustment will be made).


1.6. STO’S/GROUPS

1.6.1. Full prepayment must be received prior to arrival - Proof of payment must be received by the hotel prior to guests’ arrival. The reservation number must be stated on any payment transaction. If payment is not received timeously by the hotel, guests will be charged BAR (best available rate) upon arrival and will be requested to settle directly. It is thus the responsibility of the company to ensure that payment is executed according to the above. 

1.6.2. If payments are not received within the specified time frame, we reserve the right to cancel the accommodation being held. Full cancellation fees will be charged where applicable.

1.6.3. Payment for all non-commissionable services rendered (beverages, telephone, laundry, etc) must be received from the guest on departure, unless pre-approved credit facilities have been authorised.

1.6.4. Zulu Nyala reserves the right to amend all tariffs should there be any change in VAT, statutory levy or tax becoming payable by Zulu Nyala Group after date of signatory of this agreement.

1.6.5. The third person sharing rate is based on the sharing rate of the applicable rates category, at applicable room types only. 

1.6.6. Cancellations will only be accepted in writing. Zulu Nyala reserves the right to alter the deposit, payment and cancellation conditions during peak demand periods.

  • All cancellations will only be accepted upon written confirmation thereof.

  • During periods of high demand and for certain rates some hotels may impose stricter cancellation rules; the hotel will contact you should this affect your reservation.

  • NO-SHOWS will be charged at 100% 

1.6.7. Group/Tour cancellation policy states that up to 30 days prior to the stay date there will be no charge. 29 to 0 days prior to the stay date, the agency will be 100% accountable for the cancellation fee.

1.6.8. FIT cancellation policy states that up to 14 days prior to arrival: (or on making the reservation within 14 days), payment in full must be received by the reservations department. Cancellations within 7 days and no-shows will be charged in full.


1.7. EXCLUSIONS

1.7.1. Unless expressly included, costs such as passport and visa fees, airfare & airport transfer, travel insurance, excess baggage fees, personal expenses (e.g. drinks, laundry, telephone calls, gratuity), and extra activities/excursions are not covered in our package pricing.


1.8. BOOKING PROCESS/DEPOSIT POLICY 

1.8.1. Guests must inform The Zulu Nyala Group of any booking-related updates or changes in writing via email. The burden of proof of delivery rests with the guest.

1.8.2. To qualify for the STO rates all bookings must be emailed to our reservations team on: reservations@zulunyla.com

1.8.3. The Zulu Nyala Group may attempt to extend provisional bookings upon written request from our guests.

1.8.4. Prior to confirming any Reservation, guests must possess the required deposit payment and travel insurance. The latter can be facilitated through The Zulu Nyala Group with a third party.

1.8.5. All bookings must be secured with a bank deposit or credit card details at time of booking

All accounts must be settled in full with the hotel prior to the guest’s arrival. Failure to pay accounts could result in the guest not being checked in.

1.8.6. Confirmed reservations are invoiced according to the provisions for independent travellers, groups & organisations. 

1.8.7. Confirmed accommodation is subject to payment and cancellation policies specified for independent travellers or group reservations.

1.8.8. Amendment, Reduction, Refund, and Cancellation Policy:

1.8.8.1. An amendment will refer to a change in travel / arrival date and / or an increase or reduction in number of rooms or services required, after confirmation.

1.8.8.2. All amendments made will be subject to the cancellation policy.

1.9.1. Reservations held by The Zulu Nyala Group where no deposit has been paid by the Guest or where no guarantee has been given will be cancelled by The Zulu Nyala Group on notice to the guest;

1.9.2. Refunds will not be made for any missed services in respect of your booking.

1.9.3. In the event of cancellation of a booking, The Zulu Nyala Group shall be entitled to retain such portion of the Booking as may be prescribed by relevant consumer protection legislation.

1.9.4. On cancellation of a confirmed independent traveller/s reservation The Zulu Nyala Group will be entitled to:

  • 0% of the total confirmed rate if cancelled 121 days or more prior to arrival.

  • 50% of the total confirmed rate if the booking is cancelled between 46 and 120 days prior to arrival.

  • 100% of the total confirmed rate if the booking is cancelled between 0 and 45 days prior to arrival.

  • A 5% Bank fee will apply for any refund request.

1.9.5. On cancellation of a confirmed Group reservation The Zulu Nyala Group will be entitled to:

  • Zulu Nyala reserves the right to alter the deposit, payment and cancellation conditions during peak demand periods.

  • All cancellations will only be accepted upon written confirmation thereof.

  • During periods of high demand and for certain rates some hotels may impose stricter cancellation rules; the hotel will contact you should this affect your reservation.

  • NO-SHOWS will be charged at 100%. A No-show fee of one night's accommodation will be charged for guaranteed reservations that are not cancelled within 48 hours prior to the arrival date. 

  • PREPAYMENT REQUIRED PRIOR TO ARRIVAL. 

1.9.6. All amendments, reductions, refunds and cancellation policies for groups will be determined at the sole and unfettered discretion of the suppliers utilised in any itinerary.

1.9.7. In the event of any credit card payment dispute the guest shall refrain from filing any unfounded or unlawful payment dispute (“chargeback”) with the guest’s issuing bank without first attempting in good faith to resolve the dispute with The Zulu Nyala Group. The Guest acknowledges that any unlawful or unfounded chargeback will result in The Zulu Nyala Group sustaining financial loss which will entitle The Zulu Nyala Group to institute appropriate remedial action to mitigate against such loss which action may include, without limitation, challenging the grounds with the guest’s issuing bank the grounds on which the chargeback was requested by the Guest or instituting legal action as may be deemed appropriate to enforce the rights of The Zulu Nyala Group.

1.9.8. Children under the age of 3 years stay free, children 4 to 12 years pay between USD850/940 depending on which season they stay. Upgraded rooms will require a surcharge. 13 years and older are considered adults and the full rate will apply.  


2.1. GUEST’S ACKNOWLEDGEMENTS & RESPONSIBILITIES / PASSPORT AND VISA REGULATIONS

2.1.1. Due to the Immigration Amendment Act no.19 of 2004, positive personal identification will be required at the time of making your booking or upon check in. A valid Passport or an ID Document will be acceptable.

2.1.2. Guests must ensure their passport is valid for 6 months after their expected date of return and has a minimum of 4-6 blank pages.

2.1.3. US citizens do not require a visa for business travel or travel for tourism if their stay is less than 90 days.

2.1.4. If guests are planning on visiting any of the countries neighbouring South Africa, they must ensure that they have the necessary documentation.

2.1.5. Please note that as of June 1 2015, new immigration regulations have been instituted. These new regulations pertain to the travel of minors to South Africa. It is now a requirement that children under 18 years of age, travelling with parents/family must produce a parental consent affidavit as well as a certified copy of their birth certificate.

2.1.6.  All reservations made shall be made on the trading terms contained in this document and any relevant annexures.

2.1.7. To guarantee the reservation, the following must be provided: 

A) Prepayment of the FULL ACCOMMODATION, or as indicated on this confirmation of the reservation. 

B) Details of one of the following recognised credit cards: Mastercard or Visa Card. 

C) The hotel reserves the rights to cancel non guaranteed reservations at 6pm on the day of arrival, if a credit card authorisation / pre-payment has not been received, or as indicated on this confirmation of the reservation.


2.2. CHECK IN/CHECK OUT TIMES

2.2.1. Check in time is from 14h00, and rooms should be vacated by 10h00.

2.2.2. Day use rooms are reserved strictly on request and subject to availability. The rate will be negotiated on the day. 

2.2.3. A day use room will be available until 6pm, thereafter the full rate will be charged.
